Factors Associated with Successful Restoration of Competence to Stand Trial

  • STATUS

Updated on 19 February 2024

Summary

In Indiana, criminal defendants adjudicated incompetent to stand trial due to mental disease or defect undergo court-ordered psychiatric hospitalization for competence restoration. These involuntary hospitalizations last months to years and result in significant costs, both in loss of liberty for these individuals and state costs for expensive, prolonged hospital stays.

In an effort to identify clinical and demographic factors associated with successful and timely competence restoration, we plan to retrospectively review medical records of individuals admitted to Logansport State Hospital for competence restoration from 2001-2013. Using information gained from these chart reviews, we plan to create a de-identified database of clinical, demographic, and legal information. We will then subject this database to statistical analysis to identify factors associated with restoration success. Hospital records from Logansport State Hospital and other Indiana Division of Mental Health and Addiction (DMHA) state hospitals to which and individual may transfer will be used to determine the ultimate outcome of an individual?s hospitalization and competence restoration success.
